This document is the official public proposal (offer) of Individual Entrepreneur Svetlana Zinnurovna Vakhitova (the “Provider”) to enter into an agreement on the terms below with any individual with legal capacity who responds to this Offer (the “Customer”). Under paragraph 2 of Article 437 of the Civil Code of the Russian Federation, this Offer is public. The Customer’s performance of the actions specified in Section 4 of this Offer (acceptance) constitutes full and unconditional acceptance of all its terms (Article 438 of the Civil Code of the Russian Federation) and conclusion of an agreement (the “Agreement”) on the terms of the Offer.
ATTENTION. Before making payment, carefully read this Offer, the description of the selected Plan, the Personal Data Processing Policy, and other documents published on the Website. Pay particular attention to Section 8 (Time of Service Delivery), Section 10 (Intellectual Property), and Section 11 (Refunds and Termination): the service of providing access to materials (the License Component) is considered fully delivered when access is opened, and funds paid for it are not refundable after access is opened, as payment for a service actually delivered. The Customer retains the right to withdraw from the Agreement and obtain a refund for services not actually delivered under Article 32 of the Russian Federation Law “On Consumer Rights Protection”.

1.11. Plan - the scope of services, Content, and access selected by the Customer: “Self-study”, “Online with Guzal”, “Offline Group, Ufa”, or “Offline Individual, Ufa” (Section 6). The Intensive (clause 1.6.1) is not a Plan and is purchased independently.
1.12. Practitioner Kit - a set of oils and/or consumables and tools (a physical product), which may be included in certain Plans or purchased additionally; its contents are specified in Appendix No. 2.
1.13. Access Period - the period during which the Customer can access Content in the Personal Account.
1.14. Simple (non-exclusive) license - the right granted to the Customer to access and use Content solely for personal, non-commercial learning, without transfer of exclusive rights or a right to transfer it to third parties.
1.15. License Component - the portion of the Plan price attributable to providing access to Content (video lessons, theory, the Proprietary Oil Formula, PDF instructions).
1.16. Service Component - the portion of the Plan price attributable to “live” interaction: support and tutor work, online review of practice on a model, and an in-person practical intensive.
1.17. Acceptance - the Customer’s full and unconditional acceptance of the Offer through payment under Section 4.
2.1. The Provider undertakes to provide educational services to the Customer through distance learning (and, for the “Offline Group, Ufa” and “Offline Individual, Ufa” Plans, also in-person training) under the Customer’s selected Program Plan and grant a simple (non-exclusive) license to use Content for personal, non-commercial purposes; the Customer undertakes to pay for and accept the services.
2.2. Each Plan’s price is composite and includes separately valued components: the License Component (access to Content, including the Proprietary Oil Formula and PDF instructions as intellectual property - Articles 1235, 1286 of the Civil Code of the Russian Federation); the Service Component (tutor work, online practice, an in-person intensive); and the Practitioner Kit price (if applicable). The component price breakdown is in Appendix No. 1. The License Component price equals the price of the “Self-study” Plan, at which access to the same Content is provided separately. Each Service Component price equals the difference between the prices of the relevant Plans published on the Website on the payment date. The composite nature of the price is taken into account in refunds (Section 11).
2.3. The Provider conducts educational activities under educational activities license No. Л035-01198-02/00172856 dated 20.01.2022 (issued by the Ministry of Education and Science of the Republic of Bashkortostan). License information is available for verification in the license register. The Program delivered falls within supplementary education and is not a state-accredited program.
2.4. Upon successful completion of the Program, the Customer is issued a training completion certificate in the Provider’s established format. This document confirms completion of the proprietary Course and is not a state-standard document of education or qualification. Certificate issuance conditions: for the “Self-study” Plan, after access to all lessons is opened; for the “Online with Guzal”, “Offline Group, Ufa”, and “Offline Individual, Ufa” Plans, after completing the practical session (intensive). An electronic certificate is placed in the Personal Account and is a fully valid document of the Provider: it contains a signature, seal, number and date, and its number is entered in the Provider’s register. The original paper certificate is sent to the Customer by a delivery service (CDEK) at the Customer’s request; delivery costs are paid by the Customer as recipient (including upon receipt) and are not included in the Plan price. Under the “Offline Group, Ufa” and “Offline Individual, Ufa” Plans, the original certificate is handed to the Customer at the in-person session. Issuance of the document for the Additional “Cosmetologist-Esthetician” Program is governed by Section 7.
2.5. The proprietary method and Proprietary Oil Formula are the Provider’s original developments. The terms “proprietary method” and “proprietary formula (recipe)” used in the materials denote authorship but do not indicate a patent or other state registration, unless the Provider expressly states otherwise and provides the details of a Rospatent protection document.
3.1. Before payment, the Customer is provided with: the complete text of this Offer; a description of the selected Plan with its price and contents; the Personal Data Processing Policy; and a free introductory Course excerpt enabling the Customer to assess the nature and quality of the Content. These documents are displayed prominently on the Website payment page before the payment button.
3.2. By making payment, the Customer confirms having read this Offer, the selected Plan description, the Personal Data Processing Policy, and the introductory excerpt, and agreeing to them in full. The fact and time of acceptance are recorded by the Website’s software.
3.3. The Offer’s terms are not intended to restrict the Customer’s consumer rights established by Russian Federation legislation. Any Offer provisions that conflict in any part with mandatory consumer protection rules apply to the extent that they do not conflict with those rules; the remainder of the Offer stays in force.
4.1. Acceptance of the Offer and conclusion of the Agreement occur when payment (full payment, or the first payment under an installment/credit arrangement) is received in the Provider’s account.
4.2. Acceptance means the Customer’s full and unconditional agreement to all Offer terms (Articles 437, 438 of the Civil Code of the Russian Federation).
4.3. By accepting the Offer, the Customer confirms being an individual with legal capacity aged 18 or older.
4.4. The service commencement date is the date payment is received.
4.5. Acceptance of this Offer does not constitute or replace the Customer’s consent to personal data processing. Personal data processing, advertising mailing, and image use consents are completed separately by the Customer as independent documents (separate, unticked checkboxes) outside this Offer’s text, under Section 14.
5.1. The Provider shall:
5.1.1. Provide the Customer with Personal Account access (login and password) according to the selected Plan after receipt of payment;
5.1.2. Provide Content within the scope of the selected Plan;
5.1.3. Under the “Online with Guzal”, “Offline Group, Ufa”, and “Offline Individual, Ufa” Plans, provide online review of practice on a model; under the “Offline Group, Ufa” and “Offline Individual, Ufa” Plans, conduct an in-person intensive (in a group or individually, respectively);
5.1.4. Provide technical support on Personal Account access;
5.1.5. Consider the Customer’s complaints and respond within the period established by Section 16.
5.2. The Provider may:
5.2.1. Engage third parties (tutors, instructors, technical contractors) to deliver services while remaining responsible to the Customer for their actions;
5.2.2. Change the content, sequence, and format of sessions without reducing the selected Plan’s overall scope or quality;
5.2.3. Suspend or terminate the Customer’s Personal Account access upon an established, proven breach of the prohibitions in Section 10, subject to Section 11;
5.2.4. Reschedule online and in-person sessions under Section 6 and Section 13 with advance notice to the Customer.
5.3. The Customer shall:
5.3.1. Pay for services on time and in full;
5.3.2. Not transfer Personal Account access, login, or password to third parties;
5.3.3. Not copy, record, distribute, or publish Content, or disclose the composition and proportions of the Proprietary Oil Formula;
5.3.4. Independently ensure availability of a device, software, and internet access;
5.3.5. Comply with deadlines and conditions for practical assignments under Plans that include practice.
5.4. The Customer may:
5.4.1. Receive Content and services within the scope of the paid Plan;
5.4.2. Request technical support;
5.4.3. Withdraw from the Agreement under Section 11.
6.1. The price is determined by the selected Plan and stated on the Website on the payment date. Payment is made as 100% prepayment or under an installment/credit schedule. Payment methods: bank card through acquiring by JSC TBank (T-Bank); installments/credit (including through the “Dolyami” service); and payment in parts through “Split” (Yandex Pay). Bank and payment system fees are borne by the Customer unless otherwise stated on the Website.
6.2. “Self-study” Plan - 45 000 rubles.
Includes Personal Account access to Content: recorded video lessons on the proprietary method, theoretical materials, the Proprietary Oil Formula, PDF instructions and handouts, and recommended product links. A tutor, assignment review, and online and in-person practical sessions are not included in this Plan. The Access Period is 365 (three hundred sixty-five) calendar days from opening access. The entire price is the License Component (Content access).
6.3. “Online with Guzal” Plan - 59 900 rubles. This is a mixed agreement (elements of paid services and sale and purchase, Article 421 of the Civil Code of the Russian Federation) and includes:
(a) access to Content within the scope of the “Self-study” Plan (License Component) - 45 000 rubles;
(b) an online practical session on a model with a tutor’s review of the Customer’s work (Service Component) - 14 900 rubles;
(c) supply of the Practitioner Kit (Appendix No. 2), if included in the Plan - 0 rubles (the Practitioner Kit is not included in this Plan).
The Content Access Period is 365 (three hundred sixty-five) calendar days from opening access. The components total the Plan price (Appendix No. 1).
6.4. “Offline Group, Ufa” Plan - 69 900 rubles. This is a mixed agreement and includes:
(a) Content access (License Component) - 45 000 rubles;
(b) an online practical session with review (Service Component) - 14 900 rubles;
(c) the Practitioner Kit (if included in the Plan) - 0 rubles (not included in this Plan);
(d) a one-day in-person practical intensive in Ufa within a group; the instructor’s time and attention are shared among group participants (Service Component) - 10 000 rubles. The Provider determines the group’s composition and size.
The exact date, time, and venue address are communicated in the Personal Account and/or through the Customer’s contact details at least 7 (seven) days before the intensive. The Customer’s travel, accommodation, and meals are not included in the Plan price and are paid independently by the Customer. The Content Access Period is 365 (three hundred sixty-five) calendar days from opening access. The components total the Plan price (Appendix No. 1).
6.4.1. “Offline Individual, Ufa” Plan - 99 900 rubles. This is a mixed agreement and includes:
(a) Content access (License Component) - 45 000 rubles;
(b) an online practical session with review (Service Component) - 14 900 rubles;
(c) the Practitioner Kit (if included in the Plan) - 0 rubles (not included in this Plan);
(d) an individual one-day in-person practical intensive in Ufa: held solely with the Customer, with the instructor working exclusively with the Customer throughout the day (Service Component) - 40 000 rubles.
The Parties agree on the intensive’s date and time; the address is communicated at least 7 (seven) days in advance. The Customer’s travel, accommodation, and meals are not included in the Plan price and are paid independently by the Customer. The Content Access Period is 365 (three hundred sixty-five) calendar days from opening access. The components total the Plan price (Appendix No. 1).
6.4.2. Timing and date of the in-person intensive. The in-person intensive under the “Offline Group, Ufa” and “Offline Individual, Ufa” Plans takes place within 6 (six) months of payment. For the “Offline Group, Ufa” Plan, the Provider publishes a group schedule in the Personal Account and/or on the Website; the Customer selects an available date, which the Provider confirms. For the “Offline Individual, Ufa” Plan, the Parties agree on the date. The Customer may reschedule participation once without an additional charge to another available (agreed) date by notifying the Provider at least 48 (forty-eight) hours before the intensive starts. If the intensive cannot be held on the selected date for reasons attributable to the Provider, the Provider notifies the Customer and offers at least two other dates within the stated period; the Customer may choose one or withdraw from the in-person intensive and obtain a refund of its price within 10 (ten) days of making the demand.
6.5. Installments/credit are arranged independently by the Customer through a partner bank or installment operator on that organization’s terms; the installment/credit agreement is between the Customer and that organization. The Customer’s payment obligation is fulfilled when funds reach the Provider’s account. Overdue payments and other installment/credit obligations are governed by the Customer’s agreement with the bank/operator. Payment through installments or credit does not release the Provider from liability to the Customer for the quality and actual delivery of services: upon the Customer’s justified withdrawal, refunds are made under Section 11 regardless of payment method.
6.5.1. Payment through “Split”. When selecting “Yandex Split” on the Website, the Customer arranges payment in parts on the “Split” (Yandex Pay) service page under the terms at https://yandex.ru/support/split/ru/conditions. That page also provides details of the service operator and, for “Super Split” and “Light Split”, the creditor (lender). The service determines the payment option available to the Customer, the payment schedule, and the approval decision; the Provider does not influence them. The Customer’s payment obligation is fulfilled when “Split” confirms payment; for “Super Split”, access opens after the legally prescribed cooling-off period ends. Refunds upon the Customer’s withdrawal from the Agreement are made under Section 11 through “Split”; the service and the Customer’s bank determine when funds are credited to the Customer.
6.6. A fiscal receipt for each payment is sent to the Customer under Federal Law dated 22.05.2003 No. 54-FZ to the email address and/or phone number provided by the Customer.
6.7. “The Science of the Method” Intensive - 1 490 rubles.
Includes Personal Account access to the Intensive materials: five text lessons and three supplementary materials (a selection of scientific sources, an overview of international practices, and ready-to-use answers to client questions). Video lessons, the Proprietary Oil Formula, working protocols, client document templates, tutor support, practical sessions (online and in-person), and a training completion certificate are not included. The Access Period is 365 (three hundred sixty-five) calendar days from opening access. Access to Intensive materials ends upon expiry of the Access Period. The Intensive price is entirely the License Component (Content access); the Intensive has no Service Component.
6.8. Credit of the Intensive price toward a Plan purchase. When purchasing any Program Plan within 30 (thirty) calendar days of paying for the Intensive and using the same email address, the Intensive price (1 490 rubles) is credited toward the Plan payment; the final amount payable is reduced automatically and displayed before payment confirmation. The credit applies once and to one Plan only, is not cumulative across multiple Intensive payments, and cannot be paid out in cash. After that period, no credit is applied, while the Customer retains access to Intensive materials until the Access Period ends (clause 6.7).
7.1. The Additional vocational training Program “Body Care Cosmetologist-Esthetician” (instructor: Svetlana Vakhitova) is an independent, separately paid, voluntarily selected educational service. Purchase of the main Plan is not conditional on purchase of the Additional Program, or vice versa; the Additional Program is not imposed and is purchased solely at the Customer’s discretion (paragraph 5 of part 2 of Article 16 of the Russian Federation Law “On Consumer Rights Protection”).
7.2. The Additional Program price of 30 000 rubles is stated separately from the main Plan price. Payment may be made in one transaction with the main Plan; the Additional Program price is accounted for as a separate item in payment documents and refunds.
7.3. Training format: 2 (two) days of theoretical online sessions and 1 (one) day of in-person practical sessions in Ufa, or entirely online, as selected by the Customer at payment. Each training day is a separate service delivery stage.
7.4. After successfully completing the Additional Program and passing the final assessment, the Customer receives a document in the established format (certificate of a worker’s profession or employee position / another qualification document) with information entered into the Federal Information System “Federal Register of Information on Documents of Education and/or Qualification and Training Documents” (FIS FRDO). The document is issued provided that the Customer has secondary vocational or higher education (if required for the relevant program) and in accordance with the established program volume in academic hours. If the Customer lacks the required basic education level, a training completion document may be issued without entry in FIS FRDO; the Customer is informed of this before payment.
7.5. Education and consumer protection legislation apply to the Additional Program in full; it is not classified as “information and consulting” or “licensing”. Additional Program refunds follow Article 32 of the Russian Federation Law “On Consumer Rights Protection”, deducting the documented price of stages (training days) actually delivered.
7.6. The Customer’s withdrawal from one program (the main Plan or the Additional Program) does not entail recalculation or a refund for the other program. Refunds are calculated separately for each program.
8.1. Personal Account access (login and password) is provided after acceptance (receipt of payment). The Parties recognize opening access as the start of performance and, simultaneously, due performance of the Provider’s obligation to provide Content access.
8.2. Services are delivered in stages (by module). Each module/video lesson and each practical session (stage) is a separately delivered service with a recorded access-opening/session date. The fact and date of opening access, viewing video materials (including timecodes on Kinescope), and downloading materials are recorded by the Personal Account and video platform software and constitute proper evidence of the scope of services delivered.
8.3. The License Component (access to video lessons, theoretical materials, the Proprietary Oil Formula, and PDF instructions) is considered duly delivered by the Provider, in full and on time, when the Customer is given access to the corresponding materials in the Personal Account, regardless of whether the Customer actually views, downloads, or applies them. Platform statistics showing that access was provided are sufficient evidence of delivery.
8.4. Special terms for the “Self-study” Plan. Because the “Self-study” Plan consists solely of the License Component, its service is considered duly delivered in full when Personal Account access is opened. By accepting the Offer for this Plan, the Customer: (a) has consented to Content access immediately after payment; (b) confirms having reviewed the free introductory excerpt before payment; (c) is informed that digital Content access is provided immediately, so after access opens the amount paid for the License Component is payment for an actually delivered service and is not refundable. Before access opens, the Customer may withdraw from the Plan with a full refund (clause 11.2). This clause does not deprive the Customer of the right to withdraw from the Agreement under Article 32 of the Russian Federation Law “On Consumer Rights Protection” and does not apply where services are of inadequate quality.
8.4.1. Special terms for “The Science of the Method” Intensive. Clause 8.4 applies to the Intensive in full: the Intensive consists solely of the License Component, and its service is considered duly delivered in full when access to its materials is opened in the Personal Account. By accepting the Offer for the Intensive, the Customer: (a) has consented to material access immediately after payment; (b) confirms having reviewed the description of the Intensive’s contents and the list of research topics covered at https://guzal.ru/nauka before payment; (c) is informed that after access opens the amount paid for the Intensive is payment for an actually delivered service and is not refundable. Before access opens, the Customer may withdraw with a full refund (clause 11.2). This clause does not deprive the Customer of rights under Article 32 of the Russian Federation Law “On Consumer Rights Protection” and does not apply where services are of inadequate quality (Articles 28, 29 of that Law).
8.5. The Service Component (“Online with Guzal”, “Offline Group, Ufa”, and “Offline Individual, Ufa” Plans) is delivered in stages and cannot be considered delivered solely because access has opened. The relevant stage (online review of practice on a model) is considered duly delivered and accepted without objections if, within 3 (three) calendar days of the review (sending the tutor’s comments), the Customer has not sent a reasoned written objection to guzal.g9@mail.ru. The Parties equate absence of an objection within that period with signing a certificate of services rendered for that stage. This acceptance procedure does not deprive the Customer of rights under Article 29 of the Russian Federation Law “On Consumer Rights Protection”.
8.6. An online practical session is considered delivered when actually held on the agreed date and time. If the Customer fails to attend or is unavailable at the appointed time without giving at least 24 (twenty-four) hours’ advance notice, preparation costs and the Provider’s documented actual expenses are deducted from the session price, up to the relevant component’s price; rescheduling is at the Provider’s discretion.
8.7. The in-person intensive (“Offline Group, Ufa” and “Offline Individual, Ufa” Plans) is considered delivered in full at the end of the day on which it is actually held at the stated address. It is considered accepted without objections if the Customer signed the registration sheet (participation certificate) on the day or, within 3 (three) calendar days, did not send a reasoned written objection to the Provider’s email guzal.g9@mail.ru. This acceptance procedure does not deprive the Customer of rights under Article 29 of the Russian Federation Law “On Consumer Rights Protection”. If the Customer does not attend at the selected date and venue without a documented valid reason and without rescheduling under clause 6.4.2, preparation costs and the Provider’s documented actual expenses (model, consumables, venue rental) are deducted up to the component’s price; rescheduling beyond the case in clause 6.4.2 is at the Provider’s discretion.
8.8. The Practitioner Kit is considered transferred when handed to the Customer or to the carrier (for delivery); ownership and risk of accidental loss pass to the Customer at that time.
8.9. The Parties do not sign a separate paper acceptance certificate: services (stages) are considered duly delivered and accepted under this Section. Upon expiry of the Access Period (and, for Plans with practice, also the stage acceptance periods), the overall service is considered delivered and accepted regardless of whether the Customer has fully studied the Content and attended sessions. The Provider may generate certificates of services rendered (including electronically in the Personal Account).
9.1. Results of applying the method depend on the Customer’s individual characteristics, skin condition and type, regular and correct application, and other factors. The Provider does not guarantee a specific cosmetic result (including complete elimination of stretch marks) and is not responsible for a service failing to meet the Customer’s subjective expectations.
9.2. Program materials are educational and are not medical recommendations, diagnosis, or treatment. The method is not a medical service. The Customer applies it independently and at their own risk; in the presence of illness, allergy, pregnancy, or other contraindications, the Customer must first consult a doctor.
9.3. The Program and materials are provided within the scope stated for the selected Plan in its Website description. The Provider does not guarantee that Content will meet individual goals and expectations unrelated to the Program’s actual content stated in its description.
9.4. Any information on practitioners’ income, return on training costs, or potential earnings is informational, is not a guarantee, and does not create an obligation for the Provider to ensure any income for the Customer.
9.5. The Customer’s independent professional activities and responsibility to their clients. The Program is educational. If the Customer uses the acquired knowledge and method in their own professional or business activities after training (providing services to their clients), they do so independently, in their own name, at their own risk, and under their own responsibility as an independent provider (self-employed, individual entrepreneur, or another lawful status). The Customer independently and fully: (a) is responsible to their clients for the quality, safety, and results of services they provide; (b) ensures compliance with Russian Federation legislation, sanitary standards, qualification and licensing requirements (where necessary), health protection, consumer protection, and taxation; (c) completes necessary client documents (informed consent, questionnaires, agreements, personal data processing consents); (d) independently resolves all disputes, complaints, and demands from their clients (including refunds, compensation for harm to health, non-pecuniary harm, and losses), engaging lawyers where necessary.
9.6. The Provider (School) and instructors are not parties to the relationship between the Customer and their clients, bear no liability to the Customer’s clients, and are not responsible for the Customer’s actions or omissions, their services, or any consequences. The Customer undertakes not to hold the Provider liable for such demands and to reimburse documented losses resulting from claims made against the Provider by the Customer’s clients or other third parties in connection with the Customer’s activities.
10.1. Rights to materials. All School materials - video lessons, theoretical materials, the proprietary method, PDF instructions, handouts, presentations, images, texts, and the Personal Account structure and content - are intellectual property (works within Article 1259 of the Civil Code of the Russian Federation). Their exclusive rights belong to the Provider or are used lawfully by the Provider. Payment under the Agreement does not transfer exclusive or other rights to the Customer except the access and personal, non-commercial use rights expressly granted by this Offer.
10.1.1. Special regime for the Proprietary Oil Formula. Its composition, proportions, and preparation technology are not subject to copyright: paragraph 5 of Article 1259 of the Civil Code of the Russian Federation expressly excludes ideas, methods, processes, techniques, recipes, and composition as such from copyright. The Proprietary Oil Formula and proprietary method are protected solely as a production secret (know-how) under a trade secret regime (Articles 1465–1472 of the Civil Code of the Russian Federation, Federal Law dated 29.07.2004 No. 98-FZ). The Provider does not publish and undertakes not to publish the composition and proportions openly, since such disclosure terminates the exclusive right to the production secret (paragraph 2 of Article 1467 of the Civil Code of the Russian Federation).
10.2. Non-exclusive license. The Provider grants the Customer a limited, non-exclusive, non-transferable license to access and use materials solely for personal, non-commercial learning, for the Personal Account Access Period and worldwide. The license excludes reproduction (except technically necessary for viewing), distribution, public display, making available to the public, adaptation, resale, rental, and transfer of access or materials to third parties (sublicensing is prohibited). All rights not expressly granted remain with the Provider (Articles 1235, 1236, 1238 of the Civil Code of the Russian Federation).
10.3. Prohibitions. The Customer must not: copy, download (except where expressly permitted by functionality), record screens or videos, photograph, or otherwise capture materials; distribute, publish, or place them online, on file-sharing sites, or in group-buying pools, in whole or part; resell, give away, or transfer Personal Account access, login, or password to third parties; use materials and the Proprietary Oil Formula to train third parties; allow third parties to view materials, including the composition and proportions of the Proprietary Oil Formula and the method. One access is provided to one individual - the Customer.
10.4. Know-how and trade secrets. By obtaining material access, the Customer acknowledges the confidential nature of information constituting the Provider’s production secret (clause 10.1.1) and undertakes not to disclose it, transfer it to third parties, or use it commercially (including providing services or making and selling oil blends) for the duration of the exclusive right to the production secret. Confidentiality obligations continue after access ends.
10.5. Technical protection measures. School materials contain personal digital marks (watermarks) with the Customer’s identifier, constituting technical protection measures under Article 1299 of the Civil Code of the Russian Federation. The Customer must not remove, alter, or conceal watermarks or other protection measures. Discovery of materials bearing the Customer’s identifier openly or with third parties is recognized as proof of the Customer’s breach of this Offer unless the Customer proves otherwise (a rebuttable presumption).
10.6. Liability for breach. For infringement of the Provider’s exclusive rights (distribution, publication, or transfer of materials to third parties), the Provider may choose to demand compensation of 10 000 to 5 000 000 rubles per infringement, determined by a court, instead of damages (Articles 1252, 1301 of the Civil Code of the Russian Federation). Similar compensation (10 000 to 5 000 000 rubles at the right holder’s choice instead of damages) applies to removal or alteration of technical protection measures (Article 1299 of the Civil Code of the Russian Federation). For breach of the production secret regime, the Provider may demand damages (Article 1472 of the Civil Code of the Russian Federation). Breach may also entail administrative liability (Article 13.14 of the Russian Federation Code of Administrative Offenses) and criminal liability (Articles 146, 183 of the Russian Federation Criminal Code) under Russian Federation legislation.
10.7. Termination of access for breach. The Provider may restrict or terminate Personal Account access upon a proven breach of this Section. If access is terminated due to a proven infringement of the Provider’s exclusive rights, refunds are made after deducting the price of access actually provided and the Provider’s actual expenses (Article 32 of the Russian Federation Law “On Consumer Rights Protection”). Payment is not retained in full solely as a penalty; the Customer’s financial liability for infringement is determined separately under clause 10.6.
11.1. The Customer may withdraw from performance of the Agreement at any time by emailing an application to the Provider, paying the Provider’s actual expenses and the price of services actually delivered and goods transferred (Article 32 of the Russian Federation Law “On Consumer Rights Protection”, Article 782 of the Civil Code of the Russian Federation). This Section does not restrict statutory Customer rights.
11.2. Before Personal Account access opens, 100% of the paid amount is refunded less actual bank and payment system fees. The Customer may also withdraw with a full refund within 3 (three) calendar days of payment, provided that they have not opened access to paid Personal Account materials. The fact and time of opening access are recorded in platform statistics.
11.3. After access opens, the paid amount is refundable less the price of services actually delivered and actual expenses, which the Parties include, in particular:
(1) the License Component price (access to opened Content, the Proprietary Oil Formula, and PDF instructions), considered fully delivered upon opening access and not refundable (Articles 1235, 1286 of the Civil Code of the Russian Federation; Article 32 of the Russian Federation Law “On Consumer Rights Protection”);
(1-a) the price of “The Science of the Method” Intensive, considered fully delivered upon opening access to its materials and not refundable (clause 8.4.1);
(2) the price of tutor-led online reviews and individual consultations actually held;
(3) the price of an in-person intensive actually held;
(4) the Practitioner Kit price if it was made, shipped, or transferred to the Customer (subject to clause 11.6);
(5) the price of preparing and issuing a certificate/training document if issued;
(6) actual bank, payment system, and installment operator fees;
(7) the Provider’s actual expenses for providing and supporting video platform access (video lesson hosting) and Personal Account access during the Customer’s access period;
(8) remuneration actually paid to third parties engaged by the Provider (tutors, instructors) for work completed before the Customer’s withdrawal, where supported by documents.
11.4. Deductions are based on components actually delivered and actual expenses supported by documents, using the component prices in Section 6 and Appendix No. 1, without predetermined penalties or fixed deduction percentages. The price of services actually delivered is determined from the Content opened to the Customer and sessions actually held.
11.5. Payments for Service Component stages not yet delivered (online practice or an intensive not held) must be refunded to the Customer.
11.6. A Practitioner Kit of proper quality with individual packaging that can be opened is not returnable or exchangeable after opening for sanitary and hygiene reasons. Withdrawal before receiving the Kit entails a full refund of its price. A Kit of inadequate quality is returned under the Russian Federation Law “On Consumer Rights Protection”.
11.7. This Section does not restrict the Customer’s right to refunds or other demands for inadequate service quality or failure to match the description under Articles 28, 29 of the Russian Federation Law “On Consumer Rights Protection”.
11.8. Refunds for the Additional “Cosmetologist-Esthetician” Program are calculated separately under Section 7.
11.9. When a refund decision is made, access to Personal Account materials ends within 1 (one) working day. A refund application (complaint) is considered within 10 (ten) working days; funds are refunded within 10 (ten) working days of agreement on the refund, using the original payment method unless the Customer specifies another method. The Provider endeavors to meet justified Customer demands voluntarily within those periods.
12.1. The Parties are liable for failure to perform or improper performance under Russian Federation legislation and this Offer.
12.2. The Provider’s liability under the Agreement is limited to the price of the Customer’s paid Plan. The Provider is not responsible for the Customer’s lost profits, technical failures on the Customer’s side, lack of internet access, necessary equipment or software, or training failing to meet subjective expectations.
12.3. The Customer is responsible for the accuracy of information provided when ordering and for safeguarding their login and password.
12.4. Nothing in this Section or the Offer as a whole limits the Provider’s liability or reduces statutory penalties where such limitation or reduction is prohibited by Russian Federation consumer protection legislation.
13.1. The Parties are released from liability for non-performance due to force majeure (natural disasters, hostilities, epidemics, acts of authorities, communication and power network failures, etc.) arising after acceptance of the Offer.
13.2. The Party affected by force majeure notifies the other Party within 3 (three) working days. Performance periods are extended proportionately to the duration of those circumstances. The Provider may reschedule an online or in-person session with advance notice; the Customer may choose to participate on the new date or demand a refund for the component not held.
14.1. The Customer’s personal data is processed under Federal Law dated 27.07.2006 No. 152-FZ “On Personal Data” and the Personal Data Processing Policy published on a separate Website page. Personal data processing and storage take place in the Russian Federation.
14.2. Acceptance of this Offer is not consent to personal data processing. The Customer completes consents as separate independent documents (separate, unticked checkboxes) outside the Offer text, namely: (a) consent to personal data processing to perform the Agreement and provide Personal Account access; (b) consent to advertising mailings (Article 18 of the Federal Law “On Advertising”); (c) where necessary, consent to personal data dissemination (Article 10.1 of Law No. 152-FZ); (d) consent to use images and video recordings featuring the Customer, including “before/after” materials and practice recordings (Article 152.1 of the Civil Code of the Russian Federation), completed separately for both the Customer and the person acting as a model; (e) when personal data is transferred to operators processing outside the Russian Federation, consent to cross-border personal data transfer (Article 12 of Federal Law No. 152-FZ).
14.3. The Customer may withdraw any consent at any time under the Personal Data Processing Policy and the relevant consent.
14.4. Persons engaged by the Provider to process personal data (including the Personal Account platform, Kinescope video platform, acquiring bank, fiscal data operator, and mailing service) are listed in the Personal Data Processing Policy.
15.1. The Provider may unilaterally amend Offer terms for future agreements by publishing a new version on the Website. Changes take effect upon publication unless the new version specifies another date, and apply to agreements concluded after they take effect.
15.2. An existing Agreement is governed by the Offer version in effect at acceptance. The Provider may not unilaterally amend or refuse to perform an existing Agreement with a consumer Customer except where expressly permitted by law and this Offer.
16.1. The Parties may resolve disputes through a complaint procedure. Following that procedure is a right, not a prerequisite for a consumer Customer to bring a court action. Complaints are emailed to guzal.g9@mail.ru; the Provider undertakes to consider and respond within 10 (ten) working days of receipt.
16.2. Disputes are resolved under Russian Federation legislation. Disputes with consumer Customers follow the jurisdiction rules of Russian consumer protection legislation: at the Customer’s choice, a claim may be filed at their place of residence or stay, the place of conclusion or performance of the Agreement, or the Provider’s location (Article 17 of the Russian Federation Law “On Consumer Rights Protection”, Article 29 of the Russian Federation Code of Civil Procedure). Any term restricting this right does not apply.
16.3. Disputes with a Customer purchasing services for business purposes (if such purchase is permitted) are heard by a court at the Provider’s location.
17.1. The Agreement is effective from acceptance until the Parties fully perform their obligations. A court’s invalidation of any Offer term does not invalidate the remaining terms.
17.2. Legally significant messages are sent to the email addresses stated in the Offer and when ordering, and are considered received 1 (one) working day after sending unless earlier receipt is proven. The recipient Party bears the risk of not receiving a message sent to the current address that Party provided (Article 165.1 of the Civil Code of the Russian Federation).
17.3. Matters not governed by the Offer are governed by Russian Federation legislation.
